Under certain circumstances, Candidates, Assessors, Witness, Verifiers and Administrators enrolled on an MTCS Training Certification program, or responsible for administrating such, are protected from suffering any detriment if they make disclosures about individuals/organisations with whom they work/work for.

Definitions
Candidates: Someone enrolled on an MTCS Competence Program or Training Course
Assessors: Someone who is trained and qualified to carry out the assessment of personnel in the workplace
Witness: An individual who is deemed competent in specific role and capable of acting as a ‘Technical Authority’ to witness a candidates ability to perform a task/tasks
Verifier: Someone who is trained and qualified to monitor the quality of assessment that has been carried out in the workplace
Administrators: Normally an employee of an organisation who is a client of MTCS and responsible for managing the training and competence of personnel through MTCS Online
Individual: Someone who has committed a ‘relevant failure’
Organisation: A company or group of people within a company who have committed a ‘relevant failure’
Qualifying Disclosures
Certain disclosures are prescribed by law as “qualifying disclosures”. A “qualifying disclosure” means a disclosure of information that the individual genuinely and reasonably believes is in the public interest and shows that the individual/organisation has committed a “relevant failure” during a training or assessment activity that leads to a formal Certificate of Competence by:
- committing a criminal offence
- failing to comply with a legal obligation;
- a miscarriage of justice;
- endangering the health and safety of an individual;
- environmental damage; or
- concealing any information relating to the above
- falsifying information on documentation
- engaging in bribery or corruption
These acts can be in the past, present or future, so that, for example, a disclosure qualifies if it relates to fraudulent activity that has happened, is happening, or is likely to happen.
MTCS will take any concerns that are raised relating to the above matters very seriously.
The Procedure
- In the first instance you should report any concerns you may have to MTCS UK Ltd who will treat the matter with complete confidence.
- If you are not satisfied with the explanation or reason given to you, you should raise the matter with the appropriate official organisation or regulatory body or Trade Association.
Treatment By Others
Bullying, harassment or any other detrimental treatment afforded to a colleague/employee who has made a qualifying disclosure is unacceptable.
Anyone found to have acted in such a manner will be reported to employers and where appropriate legal authorities.
